Injured at Foxwoods or Mohegan Sun? Why Your Case Belongs in Tribal Court

By Wiss Law FirmJULY 14, 20264 MIN READ

Every year, visitors are injured at Foxwoods, Mohegan Sun, and the resorts around them — slip and falls, negligent security, hotel and parking accidents. Most are shocked to learn that they cannot sue in Connecticut state court. Both casinos sit on sovereign tribal land, and claims must be brought in the tribes’ own courts.

Foxwoods claims go to the Mashantucket Pequot Tribal Court; Mohegan Sun claims go to the Mohegan Gaming Disputes Court. Each has its own procedures, its own damage rules, and — critically — its own strict notice deadlines that are far shorter than the state statute of limitations. Miss them and the claim is gone.

Very few attorneys are admitted to practice in these courts. Attorney Jeremy D. Wiss is admitted before both, and we handle these claims from the initial notice through trial under each tribe’s specific legal framework.

If you were hurt on tribal land — the casino floor, a restaurant, the hotel, the Lake of Isles golf course, or a parking structure — call us promptly. The clock runs faster than you think.
