Cyclists Have Rights: What to Do After a Bike Accident on Long Island

By Wiss Law FirmMAY 21, 20264 MIN READ

Long Island roads are unforgiving to cyclists, and when a driver hits a rider, the injuries are rarely minor. What surprises most injured cyclists is the insurance company’s starting position: the cyclist “came out of nowhere.” Overcoming that presumption is what the first weeks of a bike case are about.

If you are able: photograph the scene, your bike, and the vehicle; preserve your helmet and clothing unwashed; get the driver’s information and every witness contact; and file a police report. Seek medical care immediately — gap-free treatment records are the backbone of the claim.

New York’s no-fault law generally covers a cyclist struck by a car for medical bills and lost earnings through the driver’s policy — a fact many riders never learn. Serious injuries open the door to a full liability claim beyond no-fault.
